Settlement, STR rules on City Council agenda

Scottsdale City Council will be presented the settlement of a  $630,000 lawsuit for less than a third of that amount this Tuesday, May 7.

According to the meeting agenda, Nationwide Insurance filed the suit for water damage the company alleges was caused by the city.

Shortly after midnight on July 5, 2022, Scottsdale Police officers alerted the City Water Department of flooding near 75th Place and Thomas Road. Emergency workers responded to the area and located a city water main break within a condominium complex parking lot,” according to the report.

“At that time, water was already pooling about a foot deep and was flowing towards properties across 75th Place …The next morning, it was discovered that water had flooded a residential home located at 2913 N. 75th Place, causing extensive damage.”

Nationwide paid over $600,000 in damages and repairs, then filed a lawsuit claiming “negligence against the city.”

The city and the insurance company have agreed to a $190,000 settlement – pending council approval.

Council also will consider amendments to the city code designed to crack down on “nuisance parties” and short-term rentals, also known as STRs.

A proposed ordinance would make it “unlawful for a promoter to advertise, permit or organize a nuisance party or unlawful gathering” and give Scottsdale Police officers “authority to order persons to leave a nuisance party or unruly gathering.”

Another amendment would make “rental of vacation rentals and short-term rentals by juveniles prohibited.”

The nuisance party/STR amendments are on the consent agenda, but may be presented for public discussion at the request of any council members.

The regular agenda features a public hearing on the Community Development Block Grant and HOME Investment Partnership Funds – totaling nearly $2 million in housing assistance.
